Guidance: Groups & Medicare Part D disclosure
Every year, employers that offer healthcare plans with prescription drug benefits to active, Medicare-eligible employees or retirees must inform them if their drug benefit constitutes 'creditable' or 'non-creditable' coverage.
This year, employers must report whether their drug benefit is creditable coverage to the Centers for Medicare and Medicaid Services (CMS) by February 29, 2024, for calendar-year plans.
To comply with the CMS disclosure requirement, plan sponsors have to complete the Creditable Coverage Disclosure Form on the CMS Creditable Coverage website, which is the sole method for compliance.
