As part of the Medicare Program, you must conduct yourself in an ethical and legal manner at all times. It's about doing the right thing!
Act fairly and honestly. Adhere to high ethical standards in all you do. Comply with all applicable laws, regulations, and CMS requirements and report suspected violations. A Code of Conduct encourages each employee, contractor, vendor, or other stakeholder to think about their actions and the consequences of behavior in the workplace. It provides broad organizational guidance with ethical and compliance principles that will guide the entity's operations and decision-making. Not every situation or challenge you may encounter will be addressed in your Code of Conduct, but it can serve as a reference point in the event you find yourself with an ethical dilemma. As always, you should contact your Compliance Officer or Warner Pacific’s Compliance Department in the event that you are unsure of what to do. In the below links, you will find some of our carrier partners codes of conduct for your reference. Each organization should have its own code of conduct that identifies the expectations of ethical behavior and the consequences of missing those expectations. In the event that you do not have a Code of Conduct, please make sure you are reviewing one of these examples to ensure that you are meeting the carriers guidelines for ethical behaviors.

CMS Final Rule: Field Agent Call Recordings / Disclaimers
CMS recently published guidance on announcing changes related to Medicare Marketing for coverage year 2023. In this announcement, new guidance states that field agents must record all calls with beneficiaries in their entirety, including the enrollment process. You can access the full publication from the Federal Register can be found here.
The key takeaways of these changes are:
- All field agents must begin recording all phone calls with beneficiaries including the enrollment process. HIPAA and retention guidelines must also be taken into consideration.
- The disclaimer “I/We do not offer every plan available in your area. Please contact medicare.gov or 1-800-MEDICARE to get information on all your options” must be conveyed in a manner(s) below:
1. Verbally conveyed within the first minute of a sales phone call.
2. Electronically conveyed when communicating with a beneficiary through email, online chat, or other electronic means of communication.
3. Prominently displayed on third party marketing organization websites
4. Included in any third-party marketing organization marketing materials, including print materials and television advertisements.

Our MAPD and Part D partners require AHIP certification. The fee is $125 if linked through the Anthem portal.
A score of 90% is required, so read the study material carefully! In addition to AHIP you will need to complete carrier-specific training.
